Terms of service

Last updated 22 October 2026

These terms are an agreement between you and Rekt Brands Inc., a Delaware corporation (“Rekt”, “we” or “us”), for your use of rekt.trade and the Rekt app (the “service”). The risk disclosure and the privacy policy are part of these terms.

By signing in or using the service you accept these terms. If you do not accept them, do not use the service.

[Effective date: owner to supply]

1. Who we are

Rekt Brands Inc. is a corporation registered in Delaware, United States. Our team works from the United Kingdom. You can write to us at legal@rekt.trade.

[Owner to confirm the contracting entity for each part of the service. If trading, rooms or the token programme move to another company, name that company here for that part.]

$REKT is a token launched by a foundation in the Cayman Islands. Rekt Brands Inc. did not issue $REKT and does not sell it.

2. Who can use Rekt

You may use the service only if all of the following are true:

  • You are at least 18 years old and able to enter into a binding contract.
  • You are not located in, ordinarily resident in, or organised under the laws of Cuba, Iran, North Korea, Syria, Russia, Belarus, or the Crimea, Donetsk, Luhansk, Kherson or Zaporizhzhia regions of Ukraine.
  • You are not named on, or owned or controlled by anyone named on, a sanctions list kept by the United States, the United Kingdom, the European Union or the United Nations, and you are not acting for such a person.
  • Using the service is lawful where you are.

Perpetual futures (“perps”) are not available to US persons. A US person means anyone who is a citizen or resident of the United States, anyone located in the United States, and any company or other entity organised or based there.

[Owner to confirm any further regional limits before launch. The legal review recommends no perps for the United Kingdom and the European Union, no spot trading for the European Union, no paid rooms for UK and EU consumers, and no $REKT rebate or referrals for UK users.]

By using the service you confirm that you meet these conditions, and you confirm it again each time you use a feature with its own limits. You must not use a VPN, proxy or any other tool to hide where you are. We block some regions automatically using your IP address. We also check the wallet addresses on your account against sanctions lists when you sign in and before you move money, and if one is listed we refuse further trades and payments through the app. If we learn that you are not eligible, we may suspend or close your access without notice.

3. Your wallet is yours

When you sign in, Privy, a third-party wallet provider, creates a self-custodial wallet for you. Your wallet is controlled through your sign-in. Rekt never holds your funds and cannot move them out of your wallet.

Because the wallet is self-custodial:

  • We cannot recover your wallet or your keys if you lose access to your sign-in.
  • We cannot reverse, cancel or change a transaction once it has been sent.
  • We cannot freeze, return or seize funds, including funds sent to the wrong address.

You are responsible for keeping your email, Google, Apple or X account secure. Transactions on public blockchains are public and permanent.

4. Trading

Spot trades. When you buy, sell or move a token, the trade is routed through Relay, a third-party routing service that finds a route and carries out the swap, including moving funds between networks where a trade needs it. Relay has its own terms, which apply to your use of it.

Perps. Perpetual futures run on Hyperliquid, a third-party perpetuals exchange. Your perps account is on Hyperliquid under your own wallet address, and Rekt is a front end to it. Hyperliquid has its own terms, which apply to your use of it, and its own rules for margin and liquidation.

The first time you trade perps you approve two permissions from your wallet. The first is a trading key that Rekt generates and stores encrypted on its servers. It can place and cancel orders on your perps account and cannot withdraw funds. We use it only to carry out orders you place in the app. The second is a cap on the fee Rekt may charge per order. You can ask us to delete the trading key at any time by writing to legal@rekt.trade.

Quotes and orders. Prices move. A quote is an estimate that expires after a short time, and the app takes a new one before you confirm if the old one is stale. A trade can fail, fill only in part, or fill at a different price within the slippage you accept. A trade is final once the network confirms it.

We are not a party to your trades. We do not trade against you, hold your orders, or guarantee that any trade will be carried out.

5. Fees and the $REKT rebate

Rekt charges a fee on each trade. Today it is 0.4% of the amount of a spot trade and 0.05% of the value of a perps order, charged when you open and again when you close. The app shows the fee before you confirm. Routing services, Hyperliquid and the networks charge their own fees, which are included in the quote or shown next to it.

Some transfers need a small amount of a network’s own token to pay network fees. Where that happens, the app may buy it from your USDC as part of the same action, and shows the cost before you confirm.

Rekt uses the fees it collects to buy $REKT on the open market about once an hour. Of each purchase, 70% is burned, which means it is sent to an address that nobody controls so it can never be used again, and 30% is returned to traders as a rebate. The buy and burn is how Rekt spends its fees. It is not support for the price of $REKT, and we make no promise about that price.

Once a day, the rebate share is paid in $REKT to the wallets of people who paid trading fees in that period, in proportion to the fees each paid. A rebate worth less than about $0.25 is not paid. The rebate is a partial return of fees you have already paid, paid in a different asset. It is not interest, a reward for holding $REKT, or an investment return, and its dollar value when it reaches you may be higher or lower than when it was bought.

If someone joins with your referral link, you earn extra rebate weight equal to 10% of the fees they pay during their first 90 days. It comes from the same shared rebate and does not add to the fees they pay.

We may change our fees, the split between burn and rebate, the timing of purchases and payments, or end the rebate or referrals. A change applies only to trades made after it takes effect, and the current fee is always shown before you confirm.

[Owner to update this section if the buy, burn and rebate move to the Cayman foundation under a programme agreement, as the legal review recommends.]

6. Rooms

Rooms are spaces run by other users (“room owners”) where they share their trades and views and members can chat. Some rooms are free, some need a paid seat, and some are open to people who hold a coin or reach a trading milestone.

Seats. A paid seat is priced in USDC by the room owner and lasts 30 days. It does not renew automatically. When you pay, 80% goes from your wallet straight to the room owner and 20% goes to Rekt, as two separate transfers, so Rekt never holds the owner’s share. Seat payments cannot be reversed by us.

[Refund policy for seats: owner to supply, for example a short window in which a member can ask for a refund and how the owner’s share is recovered.]

Rooms are not advice. Everything in a room is content made by users. Room owners are independent. They are not our employees or agents, we do not regulate them, and we do not review, endorse or check their calls. Nothing in a room is a recommendation suited to you. Trading records in rooms and on profiles show past trades only, and past performance tells you nothing about future results. You make your own decisions and you are responsible for them.

Rules for room owners. If you run a room you must:

  • Speak to the room as a whole, and not give advice about a member’s own money or situation, such as how much they should put into a trade.
  • Not manage, or offer to manage, anyone else’s money.
  • Not promise or project returns.
  • Disclose your own position when you call a trade, and disclose any payment you receive for talking about a token.
  • Not trade against your members, including buying before a call and selling into the buying it causes.

[Owner to publish the creator agreement, which sets out these rules in full with payout terms, verification and tax forms, and any hold period after a call.]

Moderation. Room owners and the moderators they appoint can read and remove messages in their rooms, and so can we. We may remove content, suspend a room or close an account that breaks these terms. To report content, use the report option on the message where the app offers one, or write to legal@rekt.trade.

7. What you must not do

You must not use the service to:

  • Manipulate a market, including pump and dump schemes, wash trading, spoofing, coordinated buying or selling, or trading ahead of your own calls.
  • Evade sanctions, launder money, finance terrorism or handle the proceeds of crime.
  • Hide your location or identity to get around the limits in section 2.
  • Post anything unlawful, or harass, threaten, impersonate, defraud or publish private information about anyone.
  • Interfere with the service, test it for weaknesses without our written permission, or copy it at scale. If you find a fault, tell us at legal@rekt.trade rather than using it.
  • Use someone else’s account, or let someone else use yours.

8. What Rekt is not

Rekt is software that lets you trade from your own wallet and share what you do. We are not a broker, dealer, exchange, investment adviser, custodian, bank or fiduciary, and we do not act for you in any trade. We do not give investment, tax or legal advice. You decide every trade, and you are responsible for any tax due on your trades and rebates.

9. Services run by others

The service depends on companies and networks we do not control, including Privy for sign-in and wallets, Relay for routing spot trades, Hyperliquid for perps, and the public blockchains themselves. Each has its own terms. They can fail, pause, change their rules or charge different fees, and prices and data we show from third parties can be late or wrong. We are not responsible for what they do or do not do.

10. Your content and your public record

You keep ownership of what you post. You give us a worldwide, royalty-free licence to host, show and share it as part of the service, including your username, profile and trading record.

Your trades and trading performance are public by design. If you close your account, we remove your profile details, but trades already published and the public performance records built from them, such as leaderboards and room records, stay, because other users rely on them being complete. Wallet addresses used for trading are retired rather than deleted, and nothing recorded on a public blockchain can be erased by anyone.

11. Changes, suspension and closing your account

We may change, pause or withdraw any part of the service. We may suspend or close your access if you break these terms, if the law requires it, or to protect other users or the service. Closing your access does not give us your funds, which stay in your wallet.

You can stop using the service at any time. To close your account, write to privacy@rekt.trade.

12. No warranty

The service is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will be accurate, uninterrupted, secure or free of errors, or that it will meet your needs.

13. Limits on our liability

To the extent the law allows, we are not liable for trading losses, lost profits, loss of data, indirect or consequential loss, or loss caused by market movements, third-party services, blockchain failures, or the loss or misuse of your sign-in. Our total liability to you for all claims is limited to the greater of the fees you paid us in the 12 months before the claim and US$100.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer in the United Kingdom or the European Union, your statutory rights are not affected.

To the extent the law allows, you agree to cover our reasonable losses and costs arising from your breach of these terms or from content you post.

14. Disputes

If you have a complaint, write to legal@rekt.trade first. We will try to resolve it within 30 days.

If you live in the United States, you and we agree that any dispute will be resolved by binding individual arbitration administered by [arbitration provider and rules, owner to confirm], seated in [seat, owner to confirm], and not in court, except that either of us may bring an individual claim in small claims court. You and we each waive the right to a jury trial and to take part in a class action, class arbitration or representative action. You may opt out of arbitration by writing to legal@rekt.trade within 30 days of first accepting these terms.

These terms are governed by [governing law, owner to confirm], and any dispute not sent to arbitration will be heard in [courts, owner to confirm].

If you are a consumer in the United Kingdom or the European Union, you keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in your local courts.

15. Changes to these terms

We may update these terms. We will show the date of the latest version at the top of this page, and we will tell you in the app at least 14 days before a material change takes effect. If you keep using the service after that, the new terms apply. If you do not accept them, stop using the service.

16. General

These terms, the risk disclosure and the privacy policy are the whole agreement between you and us about the service. If a court finds part of them unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer these terms to anyone else. We may transfer them to a company that takes over the service, and we will tell you if we do.

Questions about these terms go to legal@rekt.trade.
